TERMS AND CONDITIONS
These terms and conditions govern the basis on which customers will be admitted to the Event. Any person who does not comply with these terms and conditions in part or in full may be asked to leave the Event and no refund will be given.
1. DEFINITIONS
“Event” shall mean, the Halloween Horrors event scare event in all its entirety, part or variation (including but not limited to: children’s, teens, adult and any escape room) at Fort Amherst, Chatham.
“Customer” shall mean, any person who has purchased, or won, or been given, or obtained in any other way, a ticket to attend the Event at Fort Amherst: Fort Amherst, Dock Road, Chatham, Kent ME4 4UB.
“Booking Website” shall mean, either www.fortamherst.com or www.halloweenhorrors.co.uk.
“Company” shall mean, Fort Amherst Halloween Limited (company number: 08539599), whose registered address is Fort Amherst, Dock Road, Chatham, Kent, ME4 4UB
“Party Leader” shall mean, any person who has purchased tickets on behalf of themselves and any other person.
“Tour” shall mean, any activity for which a ticket has been purchased, including but not limited to the Halloween Horrors tunnel tour, an escape room experience, or the Children’s Tour.
“Children’s Tour” shall mean, the Children’s Halloween Horrors Tunnel Tour and/or Halloween Party, or any other variation as may change from time to time.
“Booking Time” shall mean, the allocated time for the Customer’s Tour.
2. BOOKING
2.1. All advance bookings must be made online via the Booking Website.
2.2. Bookings may only be made by persons over the age of eighteen (18).
2.3. Where an individual is booking tickets on behalf of themselves and other members of a group, that Customer or Party Leader must be authorised to make the booking on the basis of these Terms and Conditions by all persons involved in the booking and by their parent or guardian for all party members who are under 18 when the booking is made.
2.4. In all cases, the Party Leader is responsible for making all payments due to Fort Amherst Halloween Limited.
2.5. A confirmation email will be sent to the Party Leader or Customer, upon making a booking. This will be sent to the email address which was provided at the time of making the booking. This may be filtered to a spam folder and it is the responsibility of the Party Leader or Customer to check all such folders.
2.6. Any mistakes made by the Party Leader or Customer when making a booking cannot be undone or rectified once completed. The Company cannot accept liability for any loss or damage incurred as a result of the Party Leader, or Customer’s, error when booking and no refund will be given.
2.7. There may be limited tickets available to purchase at the Event but the Company does not guarantee that any such tickets will be available and cannot accept any liability for loss or damage caused as a result of any reliance or expense incurred by you should tickets be unavailable at the Event.
2.8. The Company reserves the right to vary the price of tickets sold at the Event to that of those booked online in advance, without notice.
2.9(1). Customers and Party Leaders should arrive a minimum of thirty (30) minutes prior to the time of the Tour that they have booked. In the event that Customers or Party Leaders arrive late, the Company will endeavour, with no obligation to the Company, to include them on a later tour. The Company will not provide any refund for Customers or Party Leaders who are unable to attend the event or who arrive late.
2.9(2). Customers who arrive late may receive an email offering to change there booking time and date. Acceptance of that amendment will incur an admin fee of £10 and is subject to availability with no obligation on the Company and no refunds shall be issued if there is not any availability.
2.10. The Booking Time is an approximate time and does not guarantee entry or commencement of tour at the exact time shown. Tours may be slightly longer or shorter than advertised. Customers and Party Leaders are responsible for making suitable arrangements and the Company cannot accept liability for, or make payment towards, any expenses, costs or losses incurred by you as a result of any unsuitable arrangements made by the Customer or Party Leader.
3. Suitability of Event
3.1. The nature of the Event means that it is designed to be frightening. The Company cannot accept any liability for loss, or provide a refund, to any Customer who decides not to complete the Tour.
3.2. The Company will not provide a refund to any person who does not become frightened, or enjoy themselves, during the Event.
3.3. Children’s Halloween Horrors Tour
(a) The Children’s Tour is suitable for children aged four (4) to ten (10) years. However, there are sections which are dark and more sensitive children may find some scenes frightening. Parental guidance is advised and the Party Leader should consider this when booking. No refund will be given should a child or supervising adult become frightened and not enter, orwant to leave the Event early.
(b) Children must be accompanied by an adult, who will supervise them at all times and ensure compliance with these Terms and Conditions.
(c) A complimentary ticket will be provided to one (1) adult for each Children’s Tour booking.
3.4. Halloween Horrors Tour
(A)The Halloween Horrors Tour is only suitable for persons aged thirteen (13) years and over. This event is designed to shock and frighten, with some sections taking place in the dark and live scare actors who will make physical contact with Customers. Customers may find the tour too intense and whilst they are able to discontinue the Tour, this will be at the closest available exit that will not disturb the experience for the remainder of the Customers on the Tour. No refunds are available for any Customer leaving a tour.
(B) All guests must be thirteen (13) years of age to attend Halloween Horrors Tours. Those who are not sixteen (16) years of age, must be accompanied by an adult aged at least eighteen (18) who has a paid ticket. Parties will be refused entry without a refund if those between the ages of thirteen (13) and sixteen (16) do not have an accompanying adult, we may ask accompanying adult for Valid ID, where this is unable to be produced admission may be denied without a refund.
4. Payment
Full payment is required at the time of booking.
5. Cancellation by you
Tickets are non-refundable and non-transferable. Persons who purchase a ticket and do not attend the Event at their designated time or leave the Event before the end are not entitled to any refund and no compensation will be given.
6. Changes and cancellation by us
Occasionally, we have to make changes to, and correct errors and other details both before and after bookings have been confirmed. This can mean cancellation of confirmed bookings and we must reserve the right to do so. If we have to make a significant change or cancel, we will inform you as soon as possible. If the Event is cancelled by us for any reason, you will be entitled to a full refund of your ticket price. The Company cannot accept any liability, or make payment towards, any expenses, costs or losses incurred by you as a result of any change or cancellation.
7. Age Restrictions
The Company reserves the right to request proof of age from any Customer when commencing a Tour to verify that they are old enough to do so. The proof of age must include a photograph and be in date at the time.
The Company does not accept any liability and will not offer any refund to any Customer who had attended a Tour for which they are too young and:
(a) They have been refused entry; or
(b) They have adverse effects from the experience.
7.3. Any Customer or Party Leader found to have assisted a person under the required age to enter an inappropriate Tour may be asked to leave the Event and will not be entitled to any refund from the Company.
8. Tickets
8.1. A valid ticket is required to enter any of Tour. Customers and Party Leaders must retain their tickets at all times whilst attending the Event. The Company reserves the right to request proof of ticket from any Customer at any time. Anyone found on a Tour without a valid ticket will be escorted from the Event
8.2. Tickets are only valid at the Event for the date and time specified in the Customer’s ticket and may not be offered in connection with any offer or exchanged for cash.
8.3. The Company reserves the right to refuse entry to any person who, in its sole judgement, it deems to have presented a false or invalid ticket.
9. Security and Searches
9.1. The Company has employed a security firm to ensure the safety of the public and its staff and volunteers. Any person who does not comply with a reasonable request from a member of security, upon presenting their SIA licence, may be asked to leave the Event with the Company providing no refund or accepting liability for any costs or loss incurred by the Customer.
9.2(A). The Company reserves the right to check the contents of Customers’ bags and pockets, or any other compartment, before entry to the Event or Tour. Any Customer, Party Leader, or person found to be in possession of any of the items listed may find that those items are confiscated and not returned and/or that they are denied entry to the Event or Tour:
(a) Any drinks, cans or glass bottles
(b) Alcohol
(c) Liquids, including perfumes
(d) Deodorants and pressurised containers
(e) Illegal drugs
(f) Weapons or potential weapons, including but not limited to, guns (including air and pellet guns), knives (including craft knives, pen knives and scalpels), chisels, saws, axes, hammers and other pointed metal implements and anything else which may in the opinion of the Company, or their employed security firm, constitute a weapon or potential weapon.
(g) Sprays or aerosols or device designed to fire, water, foam or any other substance.
(h) Explosive substances
(i) Torches, lasers, or other light sources
(j) Umbrellas
(k) Masks
This is not an exhaustive list and the Company reserves the right to refuse entry to any Customer, Party Leader or person, found to be in possession of any item including, or in addition to those mentioned in the 9.2(a) – 9.2(e) which may, in their absolute discretion, cause harm. This includes where any Customer, Party Leader or person is seen to be in possession of a prohibited items while queuing, or immediately prior to entering the queue for the Event.
9.2(b). any guest that requires an adjustment to our prohibited items as for example a medical reasons or religious item (kirpan), must submit their request to the Company via an email to contact@halloweenhorrors.co.uk no later than seven days prior to attendance. A failure to do so may result in a refusal to be admitted into the event with no refund being provided.
9.3. The Company accepts no responsibility for any items confiscated or liability for the loss of any item.
9.4. Any person who in the opinion of the Company, or their employed security firm, is felt to be under the influence of alcohol, drugs or any other prohibited substance, or whose behaviour appears inappropriate in any way may be denied access to the event, or escorted from the event, with no refund given.
9.5. The Company reserves the right to remove from the Event and from the site any person who is violent, abusive, threatening or disruptive or whose behaviour is causing distress to others and no refund will be given.
9.6. Any person who is found to be in possession of illegal drugs, or instigating or participating in violence, will be reported to the Police and any drugs or related paraphernalia will not be returned.
9.7. Customers and Party Leaders are not permitted to bring torches, lasers or any other light sources into the Tour. Customers and Party Leaders are permitted to bring mobile phone devices into the Tour, but the Company reserves the right to confiscate it, or any other light source, from any Customer or Party Leader who, in the absolute discretion of the Company, is using it to the detriment of the Tour aesthetic. The Company reserves the right to remove any Customer or Party Leader from the Tour and from the Event should they fail to comply with any request to extinguish a light source.
9.8. Flash photograph or filming is not permitted during the Tour. The Company reserves the right to remove any person from site, or any Customer or Party Leader from a tour, who are found to be using flash photography or filming.
9.9. Fort Amherst is a listed Ancient Monument. Any damage to Fort Amherst is a criminal offence and any person found to be damaging the structure of Fort Amherst will be liable to criminal prosecution.
10. Disclaimer
10.1. All Customers, or persons attending the Event, should be in good general health. Due to flashing light and smoke effects, the Event is not suitable for epileptics or persons suffering from Asthma. The Event is not recommended or pregnant women, or persons with heart conditions or who are of a nervous disposition.
10.2. The ground at the Event is uneven and Customers should wear appropriate and comfortable shoes.
10.3. Customers and Party Leaders attending a Tour should be aware that actors will make physical contact with customers. Customers should not touch or assault actors, who have received training in Safe Scare Acting. Any Customer found to have assaulted an actor will be escorted from the Event and the Police may be called.
10.4. Customers and Party Leaders attending a Tour should ensure that they wear resilient and robust clothing. Customers may be pushed, pulled, dragged or otherwise touched by actors, in a controlled and safe manner. Fort Amherst does not accept any liability for clothes, footwear, jewellery, or other apparel or personal possessions that may be lost or damaged.
10.5. Customers and Party Leaders attending a Tour should be aware that there may be use of water. Fort Amherst does not accept any liability for clothes, footwear, jewellery, or other apparel or personal possessions, that may come into contact with water during a Tour or while at Fort Amherst.
10.6 . Customers and Party Leaders attending a Tour should be aware that there may be use of offensive language, profanity and sexual remarks, which may be directly personally towards a ticket holder. The Company will not be held liable for any offence caused and will not provide a refund. It is for accompanying adults to determine whether the event is suitable for any person over the age of thirteen (13) and under the age of sixteen (16) whom they are responsible. The Company will not accept liability for any emotional distress, anxiety, upset or offence caused to a person between those ages.
11. Discounted Tickets
11.1 Customers and Party Leaders using Student Discount must be able to provide a valid NUS card upon entering the event.
11.2 Customers and Party Leaders using Emergency Worker Discount must be able to provide a valid Blue Light Card upon entering the event.
11.3 Customers and Party Leaders wishing to claim a free ticket for any carers, you must apply on our website 2 weeks prior to your intended visit date, we will only accept a valid Access Card which has the +1 symbol. If your request is approved please ensure that this is displayed on your arrival.
